Terms & Conditions of Sale

  1. Payment Terms Payment Terms are strictly net and are payable on or before the last day of the month following the month of dispatch unless otherwise agreed in writing.
  2. Recommended Prices The Schedule herein is a guide only. There is no obligation to adhere to these prices, prices are subject to current discount and are subject to alteration without notice.
  3. Availability of Stock Deliveries at any time are subject to availability of stock. Not all of the items in this price list will be ex stock all states. Prices and delivery on other sizes or packs can be provided on request. No responsibility will be accepted for delays outside the seller's control. Orders which cannot be completed will be placed on back order unless otherwise advised.
  4. Delivery Victoria - F.I.S. Melbourne Metropolitan area, Geelong and Mornington Peninsula. NSW - F.I.S. Sydney Metropolitan area. QLD - F.I.S. Brisbane Metropolitan area. SA - F.I.S. Adelaide Metropolitan area. TAS - F.I.S. Hobart, Launceston & Devonport Metropolitan areas. NB: For each order placed less than $220.00 net invoice value a $20.00 delivery surcharge will apply (one order one delivery). (Adding to previous order number already dispatched will not avoid delivery surcharge). This delivery surcharge will not apply to customer pick-ups or back order. Pallets - Goods generally supplied on pallets for customer convenience. Non-return of equivalent type pallets shall incur a re-charge.
  5. Requests for Credit (a) Returns. Prior to any return of goods, approval must be obtained from the State Sales Manager of OTTER® Group Pty Ltd. Return of goods for any reason (other than if defective or supplied in error) will be subject to a handling charge of 20%, and freight on your account. Plus repacking costs if necessary. All returns must be accompanied by a request for credit, quoting the invoice number on which the goods were supplied - the return date must not exceed four months from date of invoice. Goods must be in original packaging and of merchantable quality - open packs or packs that have been damaged in store will not be accepted. (b) Other Claims: Claims for non-delivery, short delivery, incorrect goods supplied and pricing or calculation errors must be made in writing, within 7 days of the delivery date.
  6. Liability No warranty is given or shall be implied that work done or goods supplied are suitable for the buyer's purpose unless such purpose has been specified and agreed to in writing, nor shall the seller be liable for any damage resulting from unsuitability for any purpose nor any loss resulting from third party claims. Any damage recoverable as a result of any breach shall not extend to consequential damages or loss of profits on re-sale. The buyer will not represent to any third parties that it is in any way acting for OTTER® Group Pty Ltd of incur any liability or may any representations on behalf of OTTER® Group Pty Ltd and OTTER® Group Pty Ltd will not be bound by any contracts with third parties to which the buyer is a party.
  7. Retention of Title (a) Title to the products purchased by the buyer will pass to the buyer only when all that is owing to OTTER® Group Pty Ltd, in relation to the products ordered by, and delivered to, the buyer has been paid in full. (b) Risk with respect to the said products shall pass immediately from time of delivery. However until such time as the full amount owing by the buyer to OTTER® Group Pty Ltd, in relation to the said products is paid, the customer shall hold the said products as mere bailee for OTTER® Group Pty Ltd. (c) Until the products are paid for in full OTTER® Group Pty Ltd authorizes the buyer to sell the goods to purchasers but the buyer will do so as a fiduciary agent for OTTER® Group Pty Ltd. (d) OTTER® Group Pty Ltd may take possession of, and sell, any unpaid for products in the event that the customer defaults or becomes insolvent.
  8. GST GST will be charged at the current rates applicable to any taxable products.
